Thank you for visiting this website, which is an Internet property of FlexWork Sports, LLC and/or one of its controlled affiliated companies (collectively, "FlexWork Sports," "we," "our," or "us"). This Privacy Policy describes the personal data handling practices of FlexWork Sports when a user ("User," "you," or "your") visits our websites (each, a "Site") or makes use of our product and service offerings, including youth sports camps, clinics, events, athlete ambassador programming, media content, and related digital platforms (collectively, with the Sites, the "Services"). The disclosures in this Privacy Policy with respect to the personal information of a User shall be deemed to include the personal information of the User's youth participant, as applicable.

Please note that not all data handling practices described in this Privacy Policy will apply uniformly across all Sites and among the FlexWork Sports group of companies. Certain features, programs, or registration processes may vary across sports, events, and platforms. IF YOU DO NOT AGREE TO THE TERMS OF THIS PRIVACY POLICY IN THEIR ENTIRETY, YOU MAY NOT ACCESS OR OTHERWISE USE THE SERVICES.

1.  PERSONAL INFORMATION WE COLLECT

(A) Information Automatically Collected

Computer IP Addresses / Browser Type

We may collect certain information about you and your device when you visit pages of a Site. This information may include, without limitation, the type of browser you use (e.g., Safari, Chrome, Edge), your IP address, the type of operating system you use (e.g., Windows or iOS), and the domain name of your Internet service provider. We use this information to improve the design and content of the Services and to personalize your experience. We may also use this information in the aggregate to analyze usage of the Services.

Cookies

When a User visits a Site and/or interacts with one of our commercial e-mail messages, we may send one or more cookies and/or tracking files (collectively, "Cookies") to assign an anonymous, unique identifier to the applicable User's computer and/or mobile device. A Cookie is a piece of data stored on your device containing information about you. We use Cookies to improve the quality of the Services, including for storing User preferences and tracking Site usage. Most Internet browsers are initially set up to accept Cookies, but you can reset your browser to refuse all Cookies or to indicate when a Cookie is being sent. Even if you reject a Cookie, you may still use the Services; provided that certain functions may be impaired if Cookies are disabled.

Pixel Tags and Tracking Pixels

We may use tracking pixels embedded in pages of a Site or in communications such as emails. This technology helps us verify when a page is viewed, when a message or ad is opened, when links are clicked, and the originating source of a click or view. We use this information for similar purposes as information collected through Cookies, as described above.

Cross-Contextual Behavioral Tracking

FlexWork Sports, as well as third-party entities such as Google, Meta (Facebook/Instagram), TikTok, and X (Twitter), may use Cookies, pixels, and other tracking technology (collectively, "Tracking Technology") in connection with the Sites for purposes of tracking Users' activities after they leave the Site. FlexWork Sports and its third-party partners use this Tracking Technology to target applicable Users with advertisements featuring products and/or services of FlexWork Sports and/or third parties that may be of interest to Users. FlexWork Sports is not affiliated with, endorsed, administered, or sponsored by any of the foregoing third-party platforms.

Users may disable some tracking activity by utilizing the "Do Not Track" setting or similar options within most major Internet browsers, or by visiting the Network Advertising Initiative (www.networkadvertising.org/choices/) or Digital Advertising Alliance (www.aboutads.info/choices/).

Social Media Pages

We operate social media pages on third-party networks and may have social media icons on our Sites, including Instagram, TikTok, X, YouTube, and Facebook. When you visit or link to our social media pages, data may be processed by both us and the applicable social media provider. Social media providers have their own terms of use and privacy policies, and we encourage you to review those policies whenever you visit their websites or interact with their platforms.

Mobile Device Information

When using your mobile device to visit, access, or use the Services, additional categories of information we may collect include:

•       Your name and telephone number associated with your mobile device

•       Geolocation data (where you have enabled location services)

•       Mobile device ID information

(B) Information Voluntarily Provided

We also collect information that you provide to us voluntarily, such as when a User:

•       Creates and logs into an account on our platform

•       Registers for athletic events, tournaments, games, camps, clinics, or other programming (collectively, "Events"), including through third-party registration platforms

•       Registers as a player, coach, or official

•       Completes registration forms, waivers, medical releases, or other documentation needed for participants or staff

•       Registers for newsletters, live streaming, photo services, or media content

•       Purchases merchandise, equipment, or digital content (which may be hosted by a third-party e-commerce provider)

•       Uploads athlete videos, photos, or performance data

•       Applies for an employment or contractor position with FlexWork Sports

•       Accesses development and training resources, including digital and in-person programming

•       Contacts us via email, phone, mail, chat, or social media

The types of personally identifiable information we may collect include, without limitation:

•       Full name and date of birth (and in some instances, birth certificate for age verification)

•       Mailing/billing address and email address

•       Telephone number and emergency contact information

•       Credit card or other payment information, including billing and delivery addresses

•       Information on forms, waivers, and medical releases (which may contain health-related information)

•       Athlete performance data, video footage, and skill assessments

•       Parent or guardian information where the participant is a minor

Please be advised that in connection with certain Services, including Events and tournaments, you may be required to submit information through third-party websites or mobile applications ("Third-Party Platforms") that FlexWork Sports utilizes to facilitate event participation, registration, or athlete development. These Third-Party Platforms have separate privacy and data collection policies, and their practices are governed by their own privacy policies. FlexWork Sports is not responsible for the privacy practices of Third-Party Platforms.

In some instances, we may record and/or live-stream Events, which may be made available for viewing by other Users or the public, including for media, scouting, recruitment, and promotional purposes.

From time to time, our interactions with you may be conducted over telephone or video conference, and such calls or conferences may be recorded with notice as required by law.

Some of our Sites may utilize a chat feature to provide customer support. Use of the chat feature is completely voluntary. Chat sessions may be recorded. We may now or in the future provide customer support via chatbox or email that utilizes artificial intelligence (AI) and natural language processing (NLP) to simulate human conversation. If you do not consent to these terms, please do not use the chat feature and contact us via email.

2.  HOW WE USE THE PERSONAL INFORMATION

We will use your personal information for the following purposes:

•       To provide you with customer service, respond to your inquiries, and fulfill Services requested by you

•       To onboard you as a User and facilitate account management

•       To facilitate registrations, transactions, and Event participation

•       To customize your experience on the Sites and across our platforms

•       To present display advertisements and sponsored content on our Sites, which may be tailored to your interests

•       To communicate with you, including to provide status updates, Event-related information, transactional emails, and other Service communications

•       To provide notices about your account and to contact you via telephone, text, email, or chat, as permitted by law

•       To conduct research, including requesting your participation in surveys or program feedback

•       To contact you regarding your use of the Services and/or third-party products and services that may be of interest to you

•       For internal business purposes, including analyzing and managing our operations, events, and partnerships

•       To create rosters, schedules, athlete profiles, and performance tracking tools

•       To facilitate athlete ambassador programs, NIL (name, image, and likeness) activities, and university or professional partnership programming

•       To fill employment or contractor positions

•       To fulfill and comply with legal obligations to governmental authorities or third parties

•       To provide, maintain, develop, improve, and test our Services

•       To manage and assure the integrity of our platform, Sites, and Services

•       To monitor the performance of our Services and improve your user experience

•       To protect and defend the rights and property of our Users, FlexWork Sports, and third parties

•       For other legitimate business and lawful purposes as disclosed at the time of collection

3.  WITH WHOM WE SHARE THE INFORMATION

FlexWork Sports may share the personal information we collect as follows:

We may share information between and among our current and future parents, affiliates, subsidiaries, and other companies under common control and ownership for marketing and other business purposes.

We employ third parties and individuals to perform certain functions on our behalf, including helping us operate the Services, organize and administer Events, and administer related activities, including technology providers, hosting providers, e-commerce platforms, payment processors, data analytics providers, CRM providers, communications providers, professional advisors, coaches, leagues, Event facilities, athlete ambassadors, and third-party sponsors of teams, sweepstakes, contests, and similar promotions.

If you upload athlete videos or performance data, such content may be accessible to other Users, scouts, recruiters, college coaches, or the public, consistent with the purpose for which it was uploaded.

We may disclose any information we have about you if we determine that such disclosure is necessary in connection with any investigation or complaint regarding your use of the Services, or to identify, contact, or bring legal action against someone who may be causing injury to or interference with our rights or property, or the rights or property of Users. We reserve the right at all times to disclose any information that we deem necessary to comply with any applicable law, regulation, legal process, or governmental request.

We may share aggregated and de-identified information with third parties for analytical, research, or similar purposes, including with athletic associations, university partners, and sponsoring brands.

We may share your information in connection with a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of a bankruptcy, liquidation, or similar proceeding.

Notwithstanding any other language in this Privacy Policy, mobile phone numbers and SMS consent/opt-in data will not be sold, shared, or traded with any third parties, sponsors, or affiliates for marketing or promotional purposes.

4.  MOBILE MESSAGING

FlexWork Sports offers a mobile messaging program to provide Event confirmations, post-camp surveys, and follow-up communications regarding your camp experience. Consent to receive text messages is obtained explicitly via a separate opt-in at the point of registration. Providing your mobile phone number in other contexts does not constitute consent to receive SMS. Participation is voluntary and not a condition of any purchase.

Messages are limited to transactional updates and post-camp feedback. For each camp or event registration, you may receive a one-time survey text and one follow-up message for feedback or reviews. No bulk marketing or unrelated promotional texts will be sent via this toll-free number.

Text Messaging Opt-Out: You can cancel the SMS service at any time by texting "STOP." After sending "STOP," we will send you an SMS confirmation. For assistance, text "HELP."

5.  THIRD-PARTY WEBSITES AND PLATFORMS

The Services may contain links to other third-party owned and/or operated websites, including social media websites, athlete platforms, event registration apps, and other third-party platforms. We are not responsible for the privacy practices or the content of such websites and platforms. In some cases, you may be able to make purchases through third-party websites, in which case you may be required to provide certain information, such as a credit card number, directly to those sites. These third-party websites have separate privacy and data collection practices, and we have no responsibility or liability relating to them.

6.  SECURITY AND RETENTION OF YOUR PERSONAL INFORMATION

The privacy of your personal information is very important to us. We endeavor to safeguard and protect our Users' personal information using reasonable administrative, physical, and technical precautions, including encryption and written commitments from third parties who may have access to your data.

Please be advised that while we take reasonable precautions to protect your data, no storage facility, technology, software, or data transmission over the Internet can be guaranteed to be 100% secure. Any transmission of data by or through the Services is at your own risk.

Only employees or third-party agents who need personal information to perform a specific job function are granted access to personal information. Employees not adhering to our company privacy policies are subject to disciplinary action.

We retain all categories of your personal information that we collect for the maximum period permitted by applicable law. We may also use certain criteria to determine whether and when to delete certain categories of collected personal information, including: (i) date of collection; (ii) frequency of User interaction with us; (iii) last interaction the User had with us; and (iv) whether the purpose of collection has been completed.

7.  CHILDREN'S PRIVACY

No information should be submitted to, or posted at, the Sites by visitors under thirteen (13) years of age (or the applicable age of majority in their respective jurisdictions). Persons under thirteen (13) years of age are not permitted to independently access the Services and we do not knowingly collect personal information directly from such individuals. We encourage parents and guardians to participate in and monitor the interactive activities of their children. A parent or other authorized person may be required to complete and submit registration forms and waivers for a child under the age of eighteen (18). If we become aware that we have inadvertently collected personal information from a child under 13 without appropriate consent, we will take steps to delete that information promptly.

Some uses of your personal data as described in this Privacy Policy are subject to your consent, such as marketing email communications. While we do not specifically market the Services to those who reside outside the United States, we will provide accommodations for the exercise of rights provided under the European Union's General Data Protection Regulation (GDPR) and similar laws. We will endeavor to authenticate your identity and respond to all verifiable requests within forty-five (45) days of receipt. If we require more time (up to ninety (90) days), we will inform you of the reason and extension period in writing.

10. USERS OUTSIDE THE UNITED STATES

The Services are hosted in the United States and are intended for users in the United States. If you are a user accessing the Services from the European Union, Canada, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure that differ from United States laws, please be advised that through your continued use of the Services, you may be transferring your personal data to countries outside of your country of residence, including the United States, which may have different data protection rules. By using the Services, you consent to such transfer.
